Is this 1975 one cent error or what? Why is the mintmark is above 1975?

Not an error. If there is something above the date it was done after it left the mint.

intentional or accidental scratch into the surface.

mint mark on die would stand proud of the surface.

Problem is if that really happened the die would be immediately rejected and the mint worker who did it fired.
